Environmental Cleanups and Litigation

Norman Bernstein was for decades a trustee at several hazardous waste sites Including one on EPA’s National Priority List, has handled (and continues to handle) environmental litigation and has worked to minimize the risk to investors of investing in sites and businesses that may have environmental challenges.

By the way of example, he defeated arguments of the United States Justice Department in a landmark Superfund case in the United States Court of Appeals for the Seventh Circuit (Bernstein v. Bankert 2013WL3927712 (7th Circuit) and filed briefs in the United States Supreme Court, including one on behalf of NCR Corporation and two other companies. In 2017 and 2019 he completed favorable settlements for the White Plains Housing Authority for the cleanup of two adjacent properties that were interfering in a $300 million redevelopment project.

Mr. Bernstein is a former Associate Counsel at Ford Motor Company where he was responsible for all of Ford’s environmental litigation (other than automotive emissions) in including cases under the Clean Water Act, Clean Air Act, and toxic tort litigation. After leaving Ford he represented among others, US Gypsum and venture capital firms such as Alan Patricof & Co. and the Hambro International Venture Fund.
